Carnival Cruise Line Faces $5 Million Lawsuit Over Passenger’s Foot Burns on Lido Deck

Carnival Cruise Line is facing a major maritime personal injury lawsuit following a passenger’s allegation of suffering severe second-degree burns to his feet.

He suffered the injury while walking barefoot on the Lido Deck of the Carnival Magic.

The lawsuit was filed by Florida resident Jorge Luis Alverio Núñez in the Southern District of Florida on May 11, 2026, seeking damages of more than $5 million. This happened more than a year ago, on May 21, 2025, when the ship was sailing in the Caribbean.

Court documents revealed that Nunez walked two steps from the pool area to a nearby couch where her shoes were located.

According to him, the deck surface was too hot for guests to walk on barefoot, as the temperature exceeded 30°C (86°F) due to the strong Caribbean sunlight, causing burns that had to be treated medically.

These injuries are now causing mobility problems and physical disfigurements.

Nunez says Carnival Cruise Lines is to blame for its negligence in failing to provide deck safety by providing cooling measures or warning guests about it through proper signage.

Additionally, the complaint mentions that guests were not notified about wearing shoes.

Because Carnival typically recommends wearing sandals or water shoes for protection, the plaintiff claims this shows the company was aware of the risk.

The cruise company has remained silent about the ongoing legal action.

The litigation also concerns previous complaints made by passengers on social media regarding hot decks, highlighting one case in which a below-knee amputation allegedly took place. The Carnival Magic ship continues its voyages through the Caribbean from Miami.
