HHS delivered a violation notice to MAINE STATE On February 25 and declared that the State violated title IX by allowing Trans athletes to compete in Sports Girls, Pak Gazette Digital reported. Later, HHS expanded the scope of the investigation to include the Association of Directors of Maine and Grelyly High School.
The State has become a heated battlefield for the national debate about trans athletes in girls’ sports, after state legislator Laurel Libby pointed out an incident that occurred when a biological man won a pole jumping competition for girls for Grely High School in early February.
Trump then promised to cut funds to the State for refusing to follow his order on February 20, during a meeting of governors of the Republican party.
The Office of the Governor of Maine Mills responded with a statement that threatened the legal actions against the Trump administration if it retained the federal funds of the State the next day. Then Trump and Mills headed verbally on a widely publicized argument in the White House during a bipartisan meeting of governors.
Only a few hours after that interaction, the United States Department of Education announced that investigate the State to allow Trans athletes to compete in girls sports and for possible violations of title IX.
Mills, in congruence with the Association of Directors of Maine, argues that Trump’s executive order conflicts with the current human rights law of Maine. As a result, after the executive order it would challenge state law, which currently allows athletic participation based on the declared gender identity of the person.
“No president, Republican or Democrat, can retain authorized federal funds and appropriate by Congress and paid by Maine’s taxpayers in an attempt to force someone to fulfill their will,” Mills said in a statement when the HHS initially announced his investigation. “It is a violation of our Constitution and our laws, which I made an oath to defend.”
