SC to listen to the pleas for review of the reserved seat failure

A Constitutional Bank (CB) of 13 members of the Supreme Court admitted to listen to the review requests against the decision of the Apex court to grant seats reserved in the assemblies to the CB of 11 members of Pakistan Tehreek-E-Insaf (PTI), which would be assumed by a CB of 11 members on Wednesday (today).

During a hearing on Tuesday, the two members of the bank, Judge Ayesha Malik and Judge Aqeel Abbasi, dismissed the review requests as inadmissible. Later, a new list of causes was issued, which said that both judges would not be part of the bank to obtain more information about the requests.

Last year, the Supreme Court ruled that the PTI would obtain the seats reserved in the National Assembly and the provincial assemblies according to their strength in these houses. The Pakistan-Nawaz Muslim League (PML-N), the Popular Party of Pakistan (PPP) and the Pakistan Electoral Commission (ECP) have sought a review of the decision.

The requests were heard by the Bank of 13 members, led by Judge Aminuddin Khan. During the hearing, the judges raised questions about the non -implementation of the original decision of the Supreme Court, delivered on July 12, 2024.

Haris Azmat, the PML-N lawyer, argued that the reserved seats had been delivered to a part that was not even part of the case. On that, Judge Malik commented that this point had been responded in the sentence. Then he asked the lawyer to inform the court of the base of the petition.

Judge Malik said that the APEX court decision was given after hearing all the points in detail. She asked the lawyer whether or not the decision of the court was implemented. Judge Abbasi commented that there was a contempt of the Court’s request for non -implementation of the decision.

For a consultation by Judge Hashim Kakar, ECP lawyer Sikandar Bashir Mohmand told the Court that the ECP had partially implemented the decision. On that, Judge Malik commented that the ECP could not choose when implementing the judicial decision.

Later, the court postponed the hearing until Wednesday (today). The bank accepted the review requests for the initial hearing with the majority of 11-2, and issued notices to the interested parties. The bank also issued notices about the request for contempt to the court filed against the ECP.

Judge Malik and Judge Abbasi gave a dissident opinion and dismissed the requests as inadmissible at the first hearing. Judge Malik said he dismissed the three review requests as inadmissible and would issue detailed reasons later. Judge Abbasi commented that he agreed with Judge Malik.

Later, a new list of causes on the website of the Supreme Court was issued, according to which, a CB of 11 members, headed by Judge Aminuddin Khan, would listen to the requests. Judge Malik and Judge Abbasi were not included in the bank.

However, Kanwal Shauzab’s request to initiate contempt for judicial procedures against ECP for non -implementation of the judicial decision was not scheduled for the hearing in the list of new causes. In the list of previous causes, this request was included for the audience on Wednesday.
