Five IHC judges challenge the decision of SC on judicial transfers, antiquity


Five judges of the Superior Court of Islamabad (IHC) have submitted an intra-Court appeal before the Supreme Court, challenging the decision on judicial transfers and antiquity, which was ruled in favor of the IHC by the Court Apex previously, before, before, before, before, before, Express news reported.

Through the main lawyer Munir to Malik, the five judges prayed SC to annul the decision made by a five -members bank, which had confirmed the transfer of judges within the IHC.

The decision had also referred to the matter of judicial antiquity to the president of Pakistan.

They also asked SC to restrict three transfer judges, including Judge Sarfraz Dogar, to perform any judicial and administrative function as IHC judges.

In their petition, the judges have requested an immediate suspension of the June 19 decision until its intra-cat appeal is heard.

In addition, they transferred to the Court to impose an order of suspension in the determination of the antiquity of the judges transferred to the IHC, prohibit the president of Pakistan to make any decision in this regard.

The petition also requires the movement of the Judicial Commission to appoint Judge Sarfraz to give the permanent president of the Superior Court of Islamabad.

The Intra-Court appeal, together with the request for a suspension order, was presented to the Apex court after the IHC found the transfer of judges and the problem of contentious seniority.

The legal battle between the two judicial bodies has raised concerns regarding the process of judicial appointments and the determination of seniority within the highest courts of Pakistan.
