The Pakistan Electoral Commission (ECP) on Tuesday disqualified the National Assembly Jamshed Dasti for having false academic credentials.
The Commission accepted a reference sent by the president of the National Assembly along with two requests that seek Dasti’s disqualification.
A bank of the Electoral Commission of three members, directed by the ECP (Sindh) member Nisar Durrani, heard a request presented by Ameer Akbar about the assets and liabilities of MNA Jamshed Dasti.
Khyber Pakhtunkhwa’s Electoral Commission member (KP) questioned whether MNA Jamshed Dasti possessed any unleashed property.
In response, the petitioner’s lawyer argued that Dasti had listed a FA (intermediate) rating in his nomination documents, despite not having completed his registration.
The petitioner’s lawyer added that Jamshed Dasti had only submitted his registration certificate of the Karachi Board in response. Upon hearing this, the member of the Khyber Pakhtunkhwa Electoral Commission (KP) commented that the ECP had the authority to disqualify it.
The decision followed the approval of two requests against him, one of which was a reference presented by the president of the National Assembly that sought his disqualification.
The Electoral Commission has also ordered the authorities to initiate legal procedures against Jamshed Dasti.
In May, the Electoral Commission decided to have the academic credentials of Jamshed Dasti authenticated by the Karachi Education Board.
Jamshed Dasti, chosen from NA-175 Muzaffargarh in the previous general elections, faced legal procedures under articles 62 and 63, as well as sections 4, 9 and 137 of the Elections Law, 2017. The requests that seek their disqualification were presented by Ameer Akbar, Zulfiqar Dogar and Sardar Faizul Hassan.
Meanwhile, the ECP rejected the request of the opposition leader Omar Ayub to leave the case related to the assets, and postponed the audience until July 29.
A five -member bank, led by the Chief Electoral Commissioner, met to listen to the case on Omar Ayub assets.
Representing the leader of PTI and opposition leader in the National Assembly, his lawyer said that the details of assets and responsibility are required to present before December 31.
According to the rules, the Electoral Commission is authorized to initiate a complaint against a member of the Assembly within 120 days after the reception of inaccurate asset statements. However, in this case, the Commission issued the notice after April 29 of this year.
Omar Ayub’s lawyer said that the notice of the Electoral Commission violated the procedure rules and urged his retirement. However, the Commission dismissed the application.
The member of the Electoral Commission, Shah Mohammad, clarified to the legal advisor of Omar Ayub that the initial notice was issued within the prescribed period and said that the Electoral Commission had assured the provision of a fair trial.
