‘All state institutions have collapsed’

The judge of the Superior Court of Islamabad (IHC), Mohsin Akhtar Kayani, has noticed that all state institutions, including the Executive, the Parliament and the Judiciary, have collapsed.

“The Judiciary is one of the pillars of the State. This pillar now exists in a limbo,” said the main judge of the IHC.

The coalition government led the PML-N in October of last year swept the 26th constitutional amendment through Parliament, an amendment that introduced a radical change in the Judiciary.

The amendment changed the procedure for the appointment of the president of the president of Pakistan while changing the composition of the Judicial Commission of Pakistan (JCP), giving the Executive more power in the selection and elevation of the judges to the Superior Courts.

The amendment also resulted in the formation of constitutional banks in the higher courts along with an increase in the number of judges in the Superior Court. Critics saw many of these measures as attempts to control and administer the judiciary facing the judges with each other.

The additional attorney general Munawar Iqbal Duggal declared that postponing these exams would create confidentiality problems. He said that the exams are scheduled to begin on February 15 and that FPSC had the legal authority to carry out the next examination even if the previous results were not yet declared.

The court commented that if the results were not published, the exams could continue indefinitely in 2026 and 2027. “If the results had even announced a week earlier, these petitioners would not be before the court today. If FPSC had declared that the results today, the petition would have been eliminated, “he added.

In response, the president of the FPSC declared that if he could accelerate the process, he would do it, but it was not feasible. The commission had decided in greater public interest to carry out the exam in time. He assured the court that the results of the CSS 2024 exams would be announced in the last week of April.

After listening to the arguments, the court reserved its sentence and then dismissed the petition.
