The family of the retired Marshal Javed Saeed, who was arrested from his residence last year, challenged his arrest in the Superior Court of Islamabad (IHC), seeking his safe recovery.
The petition was presented under article 199 of the Constitution of Pakistan by his wife, Shazia Javed, with the Federal Government and the Pakistan Air Force (PAF) appointed as respondents.
According to the petitioner, the illegal and forced detention of her husband by the respondents, violate the fundamental rights guaranteed under the constitution of Pakistan and against the UNO/International Charter on Human Rights, of which Pakistan is also a signatory.
The petition was presented by the lawyer Inam-Ur-Rehman, who declared that the retired Marshal Javed Saeed reached the retirement age on March 18, 2021 after reaching one of the highest ranges in the PAF and attending to force with distinction.
He was allegedly kidnapped from his home in the E-9 sector, Islamabad, on January 1, 2024, by government staff. The police were contacted by PAF officials, and after a few weeks, the petitioner (his wife) was allowed to meet her husband.
During the meeting, an intelligence officer was present, and it was revealed that the PAF had stopped it and that the investigation was almost complete, with its expected release in days.
The petitioner has done everything possible to approach the PAF authorities for the release of her husband, but in vain, instead of releasing her husband, her pension that retires regularly also stopped without any legal justification.
Adding insult to injuries The medical right of the petitioner as a wife of a retired PAF officer was also illegally canceled without any reason. Later, in the petitioner’s protest, medical treatment was allowed only in the E-9 Islamabad of the PAF Hospital.
That has passed more than a year since the petitioner’s husband is under the illegal custody of the PAF authorities without the due process of law. The efforts to contact PAF’s superior officers and organize meetings were not successful.
The pension of the retired officer was arrested and the family health services provided by the government were also suspended, although his wife’s medical treatment was later restored. Despite this, the illegal arrest of the Javed Saeed Marshal continues.
According to the petitioner, if there is a pending position against the officer, it can proceed before the competent jurisdiction court in accordance with the law.
