California filed a lawsuit against the Department of Justice on Monday after officials demanded that the state’s public secondary schools confirm that they will prohibit transgender athletes in girls’ sports.

The State said in its demand that the Department of Justice “had no right to make such a demand” and cited “no authority that allows them to issue or enforce the letter of certification” to each local education agency.

California defended the laws that have been questioned, which allow athletes to participate in sports “consisting of” their gender identity and do not violate the equal protection clause of the decimocuarta amendment.

The demand said that the statutes of the State “do not classify or discriminate based on ‘biological sex’, do not require that schools deprive themselves[e] [cisgender] Students of opportunities and athletic benefits on the basis of their sex, and do not carry out any differential treatment on the basis of sex.

“On the other hand, allowing athletic participation consisting with the gender identity of the students is substantially related to the important government interests of providing all students with the benefits of an inclusive school environment, including participation in school sports, and preventing serious damage that transgender students would suffer a discriminatory and exclusive policy,” added the demand.

The State requested a court order of the lawsuit.

Last week, Deputy Attorney General Harmet Dhillon said in a letter obtained by Pak Gazette Digital that public school districts must “certify in writing” before June 9 that they will not comply with the gender identity rules of the Interscholastic Federation of California.

“Privating students and athletic benefits on the basis of their sex would constitute unconstitutional sexual discrimination under the clause of equal protection,” Dhillon wrote in the letter.

The California Interscholastic Federation governs public and private high school sports in the state and has a statute that requires its members to recognize gender identity in sports.

All students must be able to participate in school sports “in a way that is consistent with their gender identity, regardless of the gender that appears in the records of a student,” says the statute.

Dhillon, a former conservative lawyer based in California, said that the certifications he seeks in public school districts “will guarantee compliance” with Title IX and help them “avoid legal responsibility.”

California Attorney General, Rob Bonta, said in a statement the claim was presented “in advance of the imminent legal reprisals against California school systems” does not adhere to Dhillon’s demand, according to Los Angeles Times.

“The President and his administration demand that California’s school districts violate the law and violate the Constitution, or face legal reprisals. The Department of Justice did not have immediate comments about the demand.
