The Republican legislators of California pointed to Governor Gavin Newsom and the State Department of Education and the Athletics Association after they refused to comply with the Resolution Agreement of the Office of Civil Rights of Civil Rights of the Department of Education of the United States (OCR) after it was in violation of the title IX for allowing trans athletes to compensate in the sports of the girls.
American representative Kevin Kiley and state representatives James Gallagher and Kate Sánchez published statements after the Secretary of Education, Linda McMahon, announced that the California Education Department (CDE) and the Interscollastic Federation of California (CIF) dismissed the demands of the Trump administration.

“The shameless contempt for California for the security and civil rights of young women and girls is shameful,” Kiley said in a statement. “State political leaders are willing to lose federal funds to maintain politics deeply unfair to allow biological men to compete in women’s sports. This is a clear violation of federal law and common sense.
“As president of the House K-12 Education Subcommittee, I will use all the supervision tools available to hold state politicians responsible, protect our athletes and restore integrity to female athletics.”
Gallagher said the question of having trans athletes in girls sports was reduced to justice.
“California continues to push the dangerous madness of letting men compete in women’s sports,” he said. “This is justice, security and the rule of law. The Superintendent (Tony) Thurmond and Governor Newsom are endangering school sports programs throughout the state, everything to appease a radical agenda and advance their political careers.”

Sánchez added: “The Newsom Department of Education is blatantly violating title IX” and was “doubling.”
“They refuse to protect girls’ sports for biological girls. It is a shocking violation of civil rights that could cost California billions of federal education funds.”
Pak Gazette Digital communicated with the California Department of Education to obtain comments.
McMahon shared the letter from the general advisor of CDE Garfinkel to the regional director of OCR, Bradley R. Burke, Monday.
“The California Department of Education (CDE) received the Office of Civil Rights of Civil Rights (OCR) of the US Department of Education.
“The CDE does not agree with the OCR analysis, and will not sign the proposed resolution agreement.”

McMahon also shared the CIF response of his general lawyer, Diane Marshall-Freeman.
“The Office of the General Advisor of the Interscollastic Federation of California (CIF) receives its letter, dated June 25, 2025, addressed to Dr. Ronald W. Noetti, the executive director of the CIF,” wrote Marshall-Freeman. “I write in response to your request that the CIF will be informed in writing before 12:00 pm no, Eastern time, July 7, 2025,” in terms of whether the CIF will sign the resolution agreement proposed by the United States Department of Education, the Office of Civil Rights “(‘OCR’) in the field with the previous intention.
“In response to your request, keep in mind that the CIF agrees with the response of the California Department of Education (” CDE “) presented to your office today, on July 7, 2025. I have attached a copy of the CDE response for its references. Consequently, the CIF will not sign the proposed resolution agreement.”
“California has just rejected our resolution agreement to follow federal law and keep men out of women’s sports,” he wrote about X. “It turns out that the recognition of Governor Newsom that” it is an equity issue “was a great empty political presentation.

The OCR announced at the end of last month that the CIF and the CDE violated title IX.
The announcement occurred weeks after the Athletics athlete of Transgender School AB Hernández won medals in girls competitions during the state championships of California. The participation of the transgender athlete in the events caused indignation throughout the country, specifically of President Donald Trump after he signed the executive order of “no men in women’s sports”, which prohibits transgender athletes from competing against biological girls and women in sports.

In addition, “the CDE will issue a notice to all federal fund recipients (recipients) that operate interscholastic athletic programs in California that will require them Recipients must adopt the definitions based on biology of words of words and women.
“The CDE and the CIF will terminate any orientation that will advise local school districts or CIF members that allow male athletes to participate in women and girls sports to reflect that Title IX is ahead of state law when state law conflicts with title IX.
“The CDE will require that each recipient and CIF send an annual certification to CDE that the recipient and the CIF have complied with title IX. Consequently, CDE will also propose that OCR a monitoring plan to ensure that the recipients comply with title IX”.
