California rejects the proposal to keep the state title IX

The Secretary of Education, Linda McMahon, on Monday told the governor of California, Gavin Newsom, who will listen to Attorney General Pam Bondi after it was discovered that the State violated Title IX.

The California Department of Education (CDE) and the California Interscholastic Federation (CIF) rejected the resolution agreement proposed by the United States Department of Education for Civil Rights (OCR) after transgender athletes controversies in the athletics of the secondary school during the school year.

Linda McMahon shared the letter from the general advisor of CDE Garfinkel to the regional director of OCR, Bradley R. Burke, Monday.

“The California Department of Education (CDE) received the Office of Civil Rights of Civil Rights (OCR) of the US Department of Education.

“The CDE does not agree with the OCR analysis, and will not sign the proposed resolution agreement.”

McMahon also shared the CIF response of his general lawyer, Diane Marshall-Freeman.

“The Office of the General Advisor of the Interscollastic Federation of California (CIF) receives its letter, dated June 25, 2025, addressed to Dr. Ronald W. Noetti, the executive director of the CIF,” wrote Marshall-Freeman. “I write in response to your request that the CIF is in writing at 12:00 pm no, Eastern time, July 7, 2025,” as to whether the CIF will sign the resolution agreement proposed by the United States Department of Education, Office of Civil Rights “(‘OCR’) in the matter with previous care.

McMahon’s message to Newsom was clear.

“California has just rejected our resolution agreement to follow federal law and keep men out of women’s sports,” he wrote about X. “It turns out that the recognition of Governor Newsom that” it is an equity issue “was a great empty political presentation.

“The CDE and the CIF will terminate any orientation that will advise local school districts or CIF members that allow male athletes to participate in women and girls sports to reflect that Title IX is ahead of state law when state law conflicts with title IX.

“The CDE will require that each recipient and CIF send an annual certification to CDE that the recipient and the CIF have complied with title IX. Consequently, CDE will also propose that OCR a monitoring plan to ensure that the recipients comply with title IX”.

The Newsom office responded to the initial announcement, deactivating Trump administration threats to defuse California.

Newsom previously spoke about transgender participation in girls’ sports in March with the prominent conservative Charlie Kirk.

“The young man who is about to win the state championship in the length jump in women’s sports, that should not happen,” Kirk said. “You, as governor, should leave and say no. Would you do something like that? Would you say that there are no men in female sports?”

“I think it’s a problem of justice. I completely agree with you on that. It is an equity problem, it is deeply unfair,” Newsom told Kirk. “I am not struggling with the problem of justice. I totally agree with you.”

Kirk pressed Newsom about whether he would condemn the athlete in question from Jurupa Valley High School after the athlete won another event at that time. Newsom did not directly approach the victory, but said “it is a problem of equity.”

“So, it’s easy to call that,” he said. “There is also humility and grace … it is more likely that these poor people commit suicide, have anxiety and depression. And the way people talk to vulnerable communities is a problem with which I also have it badly.

Newsom also explained his point of view at a press conference on April 2 when asked if there should be a law to prohibit men from competing in girls and women’s sports.

“And I am so transparent about this as anyone, particularly in my group, about this, and to the extent that someone can and do it in a respectful and responsible way and that I can find a kind of balance, then I am open to that discussion … You are talking about a very small number of people, a very small number of athletes, and my responsibility is to address the pressing problems of our time.

“And this, I think, has been colored and armed by the right to be 10 times, 100 times larger than it is, so my approach is in a large number of other problems in this state. And to the extent that someone could find that correct balance, I would adopt those conversations and the dignity that hopes is presented in that conversation, which humanity means around that conversation, not the policy around that conversation.”
