Judge Sardar Ijaz Ishaq Khan of the Superior Court of Islamabad (IHC) on Wednesday of the cancellation of the list of causes of his court and the transfer of a case to a larger bank.

He began contempt of judicial procedures and requested responses from the Judicial Secretary of the IHC Registry and the General Lawyer.

The matter arose after all cases related to the meetings of the Pakistan Tehreek-E-Insaf (PTI) prison, Imran Khan, were scheduled to listen to a three-member bank, headed by the president of the Justice Sardar Sarfaz Dogar, Thursday (today).

Judge Khan initiated the procedure after a case of contempt of the Court occurred, presented by Mashal Yousafzai of PTI against the Superintendent of the Adiala prison.

In response to the Court notice, Deputy Director Sultan Mahmood appeared before the judge and declared that the instructions came from the president of the president of the president.

The court questioned whether the president of the Supreme Court had the authority to transfer a pending case before a judge without his consent. Judge Khan said that the court rules did not mention such powers and raised concerns about the implications of such actions.

He commented that if, hypothetically, there was “a very corrupt supreme president in the future,” such authority could open the doors to corruption and nepotism. In addition, he declared that this action was “equivalent to deceiving the Court of Justice.”

Expressing frustration, the judge commented that if the State insisted on enforcing its will, then its presence in the Court would not fulfill any purpose. He also questioned whether a judge depended on the registrar’s office to decide which cases to listen.

The deputy secretary Mahmood replied that the matter had been sent to the office of the president of the Supreme Court to obtain instructions. Judge Khan said that the largest bank’s actions were equivalent to the contempt of the procedures of his court.

PTI’s lawyer, Shoaib Shaheen, said that the State and the prison superintendent were not even parties in the case. Yousafzai added that if such actions were carried out in an open court, he raised concerns about the treatment of PTI Imran Khan and his wife, Bushra Bibi, Inside Jail.

Judge Khan replied: “We are concerned about our own institution,” and added that “the guided missile” initially addressed to them now approached the judiciary. Then, the court postponed the hearing until Thursday (today).

Meanwhile, a bank of three members, led by the president of the Interim Justice, Sardar Sarfaz Dogar, and includes Judge Arbab Muhammad Tahir and Judge Azam Khan, will listen to all cases related to the meetings of the PTI today’s founder prison.

The case of contempt of the court on Yousafzai denied meeting with Imran Khan is also among the scheduled hearings. The case was originally established for the hearing before Judge Khan on Wednesday, but was eliminated from the list of causes.
