Sean Diddy Combs filed a new appeal to the court for his immediate release with a new argument against his allegedly unfair trial.
The disgraced music mogul, 56, made the argument through his legal team Alexandra Shapiro and Nicole Westmoreland in New York on Thursday, April 9.
They claimed the Bad Boy Records founder should be freed under the First Amendment, according to details obtained by Page six.
Shapiro and Westmoreland argued that Diddy was wrongfully convicted under the Mann Act while he was involved in the creation of independent adult films, which is legal under US free speech laws.
He Last night The rapper’s legal team claimed that Judge Arun Subramanian, who was presiding over the case, used wrongful accusations against Combs to forcefully sentence him.
“We made it very clear. The District Court should not consider acquitted conduct,” Shapiro said, adding that Combs’ sentence is the “highest sentence ever imposed on a Mann Act defendant under the same level of defense.”
The lawyers demanded the immediate acquittal and release of the music mogul or at least his freedom and a new sentence with a shorter term.
However, Deputy Prosecutor Christy Slavik called the entire argument “baseless,” drawing the distinction between Diddy and adult filmmakers.
He also insisted that Judge Subramanian’s ruling was “correctly applied” given the “aggravated manner in which [Combs] committed his Mann Act crimes.”
Combs was convicted of transportation for the purpose of prostitution in July 2025 following his arrest in September 2024.
