Islamabad:
The Supreme Court has decided that the dissent notes by a judge in any matter would be made public only after the approval of the Chief of that particular bank, the sources to the Express PAkGazette said on Monday.
According to the sources, the dissident note written by Judge Ayesha Malik and Judge Aqeel Abbasi, questioning the review requests that challenge the Supreme Court, on July 12, 2024, verdict on the allocation of seating reserved in the National Assembly and the Provincial Assembly will be released only after the approval of the Head of the Constitutional Bank (CB), Justice Aminddin Khan.
In the past, if a judge dissent at the beginning of a case and left the bank, the dissident opinion used to be public on the Supreme Court website. This was a common practice during the previous main judges.
According to the procedure, if a judge wrote a dissident note, the IT department of the Supreme Court would upload it on the website immediately. This practice was also followed during the mandate of the former president of the Supreme Court Umar ATA Bandial.
Recently, Judge Malik and Judge Abbasi had dismissed the review appeals against the reserved decision of the Apex court on the first hearing of the case before the CB. The two judges sent a joint dissent note for loading on the website of the Supreme Court.
However, in a letter written to the president of the Supreme Court Yahya Afridi, Judge Malik said that the dissent of the two judges was sent to the IT department on the website of the Supreme Court, but had not risen. A CB of 11 members headed by Judge Khan will hear the case on Tuesday (today).
