Federal Constitutional Court (FCC) Chief Justice Amin-ud-Din Khan has observed that proceedings before a constitutional bench of the Supreme Court in a super tax case were wasteful. The SC made this observation on Tuesday while heading a three-member bench, including Justice Syed Arshad Hussain Shah and Justice Hasan Azhar Rizvi, hearing several petitions filed against various orders of the apex court in a super tax case. Before the passage of the 27th Constitutional Amendment in October 2025, nearly 50 hearings were held by a three-member constitutional bench of the SC, also comprising Justice Khan and Justice Rizvi. The proceedings were nearing completion when the case was transferred to the FCC formed by the amendment. The FCC took over the case on Monday. During the proceedings on Tuesday, the petitioners’ lawyers Makhdoom Ali Khan, Dr Farogh Naseem and Salman Akram Raja appeared in the gallery. Dr Naseem informed the court that the Federal Board of Revenue (FBR) would file a written reply along with its oral arguments, following which the petitioners would file their written replies. Chief Justice Amin-ud-Din Khan said the time spent earlier should be considered a waste of time. Responding, Makhdoom Ali Khan said the responsibility for this waste lay with the government. The CJ responded that no one should be blamed. Makhdoom Ali Khan clarified that he was not assigning blame but noted that the responsibility lay with the government.
