A division bank of the Superior Court of Islamabad (IHC) prevented one of his brothers Judges on Tuesday, Tariq Mehmood Jahangiri, to perform his duties, since he assumed a petition accusing Judge Jahangiri of having a doubtful title of LLB, a movement that is linked to deepen the abyss within the trial.
Interestingly, the bank comprising the president of the Supreme Court Sardar Muhammad Sarfraz Dogar and Judge Muhammad Azam Khan also sought the assistance of the Attorney General for Pakistan (AGP) Mansoor Awan about the question of whether the request is maintainable.
He also appointed Major Lawyers Zafarullah Khan and Ashtar Ali Ausaf as Amici Curiae. The Bank pointed out that until the Supreme Judicial Council (SJC), the Judges’s Responsibility Forum, which has also been addressed against Judge Jahangiri, decides the matter, the judge cannot handle cases.
The Division Bank listened to the request of Quo Warrano on Tuesday presented by defender Mian Daud against Judge Jahangiri. When the case was called, the petitioner did not appear. His assistant told the bank that Daud was not available due to a medical emergency and requested the postponement.
Interestingly, some representatives of the Islamabad Bar Association (IBA) and the Islamabad Bar Association (IBC) arrived at La Tribuna and strongly opposed the request presented against a judge in service. They qualified it not maintainable and urged the bank to discard it immediately.
CJ Dogar said that the IHC registrar’s office had also opposed the petition and that the court had not yet issued notice anywhere, including the judge. “The matter will remain pending until the SJC reaches a decision. The key question before the Court is whether a request under article 199 can appear when the matter is already sub judicily before the SJC,” he said.
The IBC member, Raja Aleem Abbasi, said the case was very worrying, since complaints against the judges are the exclusive domain of the SJC and allowing this type of requests to feel a dangerous precedent.
The CJ reminded Abbasi that, as the IHC had not issued any notice, he could not hear the argument of the members of the bar. “The constitutional role of the bars is important and will be given a chance if the court frames the questions,” he added.
The bank then restricted the case labor judge. Making an exception to the order, the Islamabad Bar Association announced a strike on Wednesday (today) both in the IHC and in the District Court. He said that a general meeting of the body would decide the future course of action and that a demonstration would also be held.
The sources said that Judge Tariq Mehmood Jahangiri intends to challenge the decision in the Supreme Court.
After the hearing, the IHC issued a new list of duty judges, excluding Judge Jahangiri. His division bank and his individual bank tasks were also removed. According to the new list, from September 17 to 19, there will be banks of three division and six individual banks available.
The First Division bank will include CJ Dogar and Judge Muhammad Azam Khan. The Bank of the Second Division, to listen only to cases related to taxes, will consist of Judge Babar Sattar and Judge Sardar Ejaz Ishaq Khan. The Bank of the Third Division will include Judge Muhammad Asif and Judge INAAM AMEEN MINHAS.
Individual banks will consist of the president of the Supreme Court Dogar, Judge Mohsin Akhtar Kayani, Judge Saman Rafat Imtiaz, Judge Muhammad Azam Khan, Judge Muhammad Asif and Judge Inaam Amen Minhas.
The list was issued by the Registrar’s office with the approval of the President of the Supreme Court.
On August 31, 2024, the union of the University of Karachi annulled the “invalid” head of Justice Jahangiri about the recommendations of the unjust committee of the University (UFM).
The statement issued by the University after the meeting did not mention the name of Judge Jahangiri, but pointed out that the Committee had proposed the cancellation of “the title cards and registration of candidates declared guilty of little ethical and immoral acts.”
The decision occurred only a few hours after the arrest of the member of the union, Dr. Riaz Ahmed, who, according to the reports, was collected by the police in an apparent attempt to prevent him from attending the key meeting.
However, the Superior Court of Sindh (SHC) on September 5, 2024 suspended the decision of the University of Karachi.
A Division Bank, which is included in Judge Salahuddin Panhwar and Judge Amjad Ali Sahito, also prohibited the University from taking more measures on a complaint against Judge Jahangiri while listening to a petition presented by the judge.
