The judge of Puisne de Islamabad (IHC) Puisne, Mohsin Akhtar Kayani, has said that what is happening to the common man is also happening to the country’s judges.
During the hearing of a case related to the Capital Development Authority (CDA), Judge Kayani painted a gloomy image of the State of different institutions on Thursday, including the Judiciary.
According to Judge Kayani, no institution was doing its job correctly.
“Tell me about a single institution in Pakistan that has been able to handle your responsibilities. He appoints an institution that is doing the work he should do,” Judge Kayani said.
The judge observed that, according to the law, all the powers of the CDA had to transfer to the Metropolitan Corporation. He said that the functions currently performing the CDA Board should legitimately belong to the local government, which also has authority over each worn break.
“The Constitution says that the elected representatives of the people will exercise authority,” he said, adding that, although the Superior Court had issued four decisions and the Supreme Court one, the Government had not yet allowed the elections of the local government in Islamabad.
Judge Kayani commented that the state of the subordinated courts was terrible. “Our spirit has been lost. Does anyone realize how 250 million people live?” asked.
In addition, he declared that there are serious governance problems, since the functions destined to be carried out by elected representatives are being carried out by the courts.
“If the right adapts to someone, they insist that the system must continue; if it does not adapt to them, the law is reserved. For five years, LG elections have not been allowed because they did not adapt to certain sectors,” he said.
Calling the “deeply unfortunate” situation, Judge Kayani said that people could only pray to improve the situation. “Everyone must do their job. Errors happen, but there should be no bad faith,” he added.
