Braian Paiz, one of two men charged in the Liam Payne death case, has been released from prison and remains in custody.
The waiter had been in prison since January after being accused of giving cocaine to the former One Direction singer before his death.
A higher court later agreed to let him return home after his lawyers said his health had changed considerably and his family situation worsened.
However, the court ordered Braian to stay inside his home and wear an electronic ankle monitor.
Judges previously refused to release him, as prosecutors claimed he might flee if released.
This time, the appeal judges decided that strict monitoring was sufficient while the case continued, on which prosecutors did not comment.
The key suspect admitted doing drugs with the No Tears creator in a Buenos Aires hotel, but denied selling anything, claiming he was being unfairly blamed.
While he was in prison, Braian said that other classmates treated him badly: they beat him, burned him with hot water and threatened him.
He also shared that the prisoners called him a “murderer” and made him fear for his life.
In addition, Braian was later transferred to a special LGBT prison area with better conditions.
The waiter’s mother said the case caused serious financial problems for the family, forcing them to sell their business and move to a poorer home.
For the uninformed, the second defendant, former hotel worker Ezequiel David Pereyra, remained in jail.
It was unclear whether he would also request house arrest.
Both men still face trial and could receive lengthy prison terms if convicted.
