LHC admits irregularities in the case of CJS authority

Islamabad:

The judge of the Supreme Court, Jamal Khan Commandkhail, has observed that irregularities will continue to prevail in the provincial higher courts provided that relevant rules are not carried out.

Judge Commandkhail was part of a bank that heard on Friday a petition that sought to regulate the powers of the main judges (CJS) of the various superior courts of the country.

Previously, the lawyer of the petitioner, Mian Daud, revealed that some CJ gave RS100M increases to certain employees of the Superior Court. He said that an employee of a provincial Superior Court is now obtaining a salary equivalent to a judge of the Superior Court thanks to these generous increases.

“There is also a case in which three notifications were issued [for the increment of an employee] In a single day, “he added. Judge Commandkhail said the judges should learn to exercise their authority properly.

During the hearing, the additional attorney general informed the Court that the LHC had submitted its response to the Court notice. Judge Muhammad Ali Mazhar said that the Superior Court had not rejected the accusations level by the petitioner.

He pointed out that, as the petition contained evidence with respect to the LHC alone, the petition should be limited to the Provincial Superior Court. The court then ordered the petitioner to modify his request. The LHC was also asked to appoint his lawyer. The case was postponed later for three weeks.
