LHC defends the judge’s dismissal about the rig

The Superior Court of Lahore (LHC) has confirmed the decision to fire a civil judge, which while acting as an officer returning (ro) during a local government election, facilitated the rig.

A bank of three LHC members, led by Judge Sajid Mahmood Sethi, announced his order written in an appeal presented by the former judge, Sheikh Ali Jafar.

Sheikh Ali Jafar was previously appointed as the RO for an election of the Union Council in Shahkot Tehsil of Punjab.

In that election, the candidate Asghar Ali Asghar was the real winner, but the civil judge declared Maqbool Ahmed Javed as the winner. Asghar then filed a complaint with the drug.

On the basis of a letter from the DRO, the Electoral Commission of Pakistan (ECP) ordered a writing of the results. A report was sent to the ECP, after which a formal complaint was recorded.

The LHC registrar dismissed Jafar in March 2006.

The Service Court suspended the dismissal order in October 2008, and the Superior Judicial Power confirmed the court ruling, while claiming that misconduct could not be proven without formal investigation.

However, after an investigation, the relevant authority again dismissed the civil judge of the service in June 2015. The judge presented an departmental appeal, which was dismissed in September 2015. Later challenged the order of the LHC.

The verdict said that the results of the elections were altered one month after the original results were issued.

The voting candidate’s number was reduced in several electoral centers and the candidate’s votes were redistributed among the loser candidates. According to a witness, when the investigation began, the civil judge begged forgiveness in the name of God of the plaintiff.

The DR testified that the electoral registry was manipulated. The court had to decide if the civil judge had the authority to alter a declared electoral result, this was one of the key questions.
