LHC summons ECP about disqualification requests

The Superior Court of Lahore (LHC) on Wednesday called the Pakistan Electoral Commission (ECP) for the requests that challenge the issuance of disqualification notifications after the convictions.

According to Express News, Judge Khalid Ishaq listened to the requests presented by Muhammad Ahmad Chattha and Muhammad Ahmad Khan Bachhar, represented by lawyer Shehzad Shaukat.

Last month, both Chattha and Bachhar were convicted in a case related to the disturbances of May 9, and subsequently disqualified by the electoral supervisor.

During the procedures on Wednesday, lawyer Arshad Nazir Mirza appeared on behalf of the member of the AFZAL SAHI Provincial Assembly.

The lawyer Shaukat argued that the ECP issued the disqualification notification without listening to the respondents, while according to article 63-A of the Constitution, a decision on disqualification can only be taken after listening to the candidate.

He argued that the court had condemned them, but the speaker of the Assembly did not receive a reference or sent one to the ECP.

He pointed out that the decision of the court was announced on July 31, but the disqualification was notified on August 5. “Is a verdict of the Anti -Terror Court as a judgment of the Supreme Court?” asked.

The court asked if the petitioners would continue to be members of the Provincial Assembly if their sentences were suspended, to which the lawyer responded affirmatively.
