Rawalpindi:
Judge Syed Amjad Ali Shah of the Special Anti -Terror Court of Rawalpindi (ATC) will hold a crucial hearing of the fourteen cases of disturbances on May 9 tomorrow (Saturday).
The hearing is produced following the order of the Supreme Court on Wednesday that defends the trials of the military courts of 105 accused of May 9. The SC has already ordered all the ATCs that have May 9 trials accused to conclude their procedures within four months.
An additional 25 accused people can be nominated for trial in military courts. A constitutional request that seeks its delivery to the military could occur at any time. The courts have been put on alert in advance of this.
In all cases of May 9 in the Rawalpindi division, except that those involving the founder of PTI Imran Khan and vice president Shah Mahmood Qureshi, all defendants are currently freely bail.
A total of 14 FIR were registered by several police stations in the division with respect to the events of May 9, but the charges only presented after a year and a half.
To date, even the charges for the GHQ attack case remains incomplete. The trials have begun based on incomplete load sheets. Until now, 73 hearings have taken place, 3 judges have been replaced in the ATC, and prison trials have been held 15 times.
In the case presented at the Railway Police Station on the attack and vandalism at the Tarnol train station, 20 PTI workers have been convicted after declaring themselves guilty. They received six -month jail terms and fines of RS75,000 each.
The process of distribution of load sheets continues in 12 other cases. A formal trial in jail is only in progress in the case of attack by GHQ, where statements of 25 of 119 witnesses have registered.
However, the defense has not yet questioned any witness. Two key witnesses in this case, the magistrate Mujtaba Al-Hahas and the sub-inspector Riaz, have not appeared during the last three months. Since February 25, the GHQ case trial has been paralyzed.
Eight suspects in the GHQ Gate 1 attack, the premeditated fire of the Metropolitan Bus Station and the attack on the office of an intelligence agency have already been tried in the military courts. Of these, six were sentenced to two, eight and ten years in prison, while two were released after one year each.
The convictions have been challenged at the Rawalpindi Bank of the Superior Court of Lahore (LHC), but these constitutional requests have not yet been scheduled for the hearing.
These requests presented more than a year ago request the trial records of the Military Court, copies of the load sheets, sentence forms and evidence summaries.
Meanwhile, the police in Lahore have requested an ATC to allow them to perform a polygraphic and photographic test of the founder Imran Khan in relation to the cases of May 9.
In this sense, the Prosecutor’s Office has submitted a request to the ATC, stating that it is necessary to carry out the test and other exams.
Opposing the request in his preliminary arguments, the lawyer of the founder of PTI, the lawyer of the lawyer of Salman Safdar, said that submitting said request after two years is an act of bad faith. The court has postponed the procedures until May 14.
