No arrest without FIR, Order of the magistrate: CB

A judge at the Constitutional Bank (CB) of the Supreme Court commented on Tuesday that no one could be arrested without the registration of the First Information Report (FIR) and the order of a magistrate.

During the hearing of the Intra-Court appeals against the decision of the main court that arrested the military trial of civilians, the CB indicated that the cases against the defendant involved in the violence of May 9, 2023 were reserved under the Law of Official Secrets (OSA) but the military was not registered in any case.

A seven-member bank, headed by Judge Aminuddin Khan, listened to the intra-cat appeals. At the beginning of the hearing, the judge of the Bank Member Jamal Khan Commandkhel, asked the lawyer of the Ministry of Defense Khawaja to complete his arguments in 20 minutes.

Haris replied that he would try to conclude his arguments at the end of the day. Given this, the additional attorney general (AAG) Amir Rehman said that if you have finished his arguments today, Pakistan Attorney (AGP) would present his arguments on Wednesday (today).

During the hearing, Judge Commandkhel said that arrest could not be made without FIR, nor could anyone be arrested without a magistrate order. Judge Muhammad Ali Mazhar said that the cases of May 9 were registered under the year, and added that the military did not register any FIR directly.

Judge Commandkhel commented that this case would have deep implications for the future. Judge Aminuddin Khan said that after the arguments of Khawaja Haris, the court would listen to AGP on Wednesday (today).

Haris commented that if the judges had not asked so many questions, he would have completed his arguments. However, Judge Musarrat Hilali, in a lighter vein, said he would not let anyone ask questions. Judge Commandkhel added that he would also refrain from asking anyone. The audience is scheduled to continue on Wednesday (today).
