PHC allows Azam Swati’s name to be eliminated from ECL

The Superior Court of Peshawar has granted the leader of Pakistan Tehreek-E-Insaf (PTI) Azam Swati permission to travel abroad, ordering that his name from the output control list (ECL) be eliminated.

According to the written order issued, the Court ordered the authorities to eliminate the name of Swati of all travel restriction lists, including the provisional national identification list (PNIL) and the passport control list (PCL).

Swati had challenged the prohibition of traveling that was imposed, arguing that the restrictions were unjustified.

Last month, the Bank of the Division of the Superior Court of Lahore (LHC) on Thursday granted the bail to the former Federal Minister and leader of the PTI Azam Khan Swati in the case of October 4 registered at the Taxila Police Station.

The bank composed of Judge Sadqat Ali Khan and Judge Sadiq Mehmood Khurram ordered the PTI leader to present a bail of RS50,000. Swati has been in custody during the last four months and is currently imprisoned in the Attock prison.

During the hearing, lawyer Dr. Babar Awan argued that Swati’s arrest was unjustified and that the protest is a constitutional right of each citizen, which cannot be denied.

He affirmed that the police had leveled false accusations against their client. The court accepted the bail statement, opening the way for its release. There are two remaining cases, in which bond is also likely.

This bail decision has also raided the way for the release of other arrested workers involved in the protests of October 4 and 5, including those of taxila, Hassan Abdal and Attock cases.

In addition, in October 2024, an anti-terrorism court (ATC) in Islamabad granted the bond to the leader of Pakistan Tehreek-E-Insaf (PTI) Azam Swati in a case presented under terrorism provisions.

The case, registered at the Sangjani Police Station, accused Swati of crimes related to terrorism after protests and vandalism.

Judge Abu al-HaSanat Muhammad Zulkernain presided over the case and approved the subsequent bail of Swati’s arrest against the bonds of RS20,000.

Swati had been arrested under terrorism clauses after accusations of inciting protests that caused property damage. Swati’s legal team said the charges were politically motivated.

In addition, Swati was arrested on Sunday after a raid on her farm in Chak Shahzad for the cyber crime wing of the Federal Research Agency (FIA) Islamabad for allegedly tweet against senior military officials in November 2022.

He was later produced before a judicial magistrate, who delivered it to the FIA in a two -day physical return.

The FIR against Swati was registered by the Wing of Cyber crimes of the FIA on November 26, 2022 on the controversial tweets that had recently published allegedly against government officials, including the former head of the Army personnel (COA).

The report said the PTI leader had begun a “very unpleasant campaign of intimidating tweets” against state institutions, including the head of the Army “with intentions of Malafia and hidden motifs.”

The FIR was registered in the state complaint through the technical assistant of the Cyber Reports Center of Islamabad, Aseesur Rehman.
