PHC Sort the Pedo petition quote

Islamabad:

A divisional bank of the Superior Court of Peshawar (PHC) on Tuesday allowed a written request presented by AGR Javed Akhtar and ordered its appointment as a member of the Pakhtunkhwa Energy Development Organization (Pedo).

The bank, which includes Judge Naeem Anwar and the Jawad Ehsanullah, revoked the decision of the provincial cabinet, which had denied the appointment based on the criteria established under the fart rules (appointment and terms and conditions of the executive directors and members), 2024.

During a hearing, Shumail Ahmad Butt, the petitioner’s lawyer, told the court that Pedo was reorganized in 2020 after the promulgation of a new farting law. According to this law, Pedo’s management was entrusted to an Executive Committee.

He explained that the Executive Committee included the Executive Director, the additional secretary of the Department of E & P and three members representing finance, renewable and hydroelectric energy.

Butt argued that the qualifications of these members were listed in section 9 (3) of the new law, while section 9 (4) declared that additional rules would govern other terms and conditions. He argued that, since the law itself prescribed the qualifications, more delegated legislation was necessary.

In addition, he declared that the positions were announced in September 2020, and the petitioner requested the member hydroelectric position. Despite being at the top of the list of merits, the recruitment process remained incomplete for several reasons. In 2024, new rules with revised grades were introduced, which finally led to the disqualification of the appointment.

He continued to say that the positions were announced in September 2020, where the petitioner had requested the hydroelectric energy position of the members. It was at the top of the list of merits, but the process was not completed for one reason or another, while in 2024, new rules were introduced and new grades were prescribed and, therefore, the request of the appointment was refused.
