PTI expels five MNA to support the 26th amendment, seeks disqualification

The expulsions were confirmed through formal notifications issued by the president of PTI, the lawyer Gohar Ali Khan. The legislators, Aurengzeb Khan Khichi, Zahoor Elahi, Usman Ali, Mubarak Zeb and Muhammad Ilyas Chaudhry, were chosen in PTI tickets and, according to the party, they had pledged to maintain their parliamentary position.

An official PTI statement said that the parliamentary meeting of the party on September 2, 2024 had unanimously decided to oppose amendment 26 at all stages. These instructions were presented to the speaker of the National Assembly on September 5 to register. However, on October 21, the five legislators voted in favor of the bill, allowing the government to approve with 225 votes, only one above the 224 required.

After the vote, PTI issued notices of the cause of exhibition to the MNA on November 5, asking why they should not be disqualified by dropout and breach of the discipline of the party under articles 62 and 63. A hearing committee was formed, but none of the legislators responded or appeared.

The party also claimed that the MNA had joined the other parliamentary part taking seats in the treasure banks and attending their meetings, which says it constitutes a formal dropout under constitutional provisions.

“Therefore, it is declared that he has violated his commitment, oath and loyalty to the party,” said the notification. “You voted in favor of the 26th Constitutional Amendment bill, 2024, and by conduct has joined another parliamentary party. Therefore, you are expelled from the party immediately.”

PTI’s leadership has also requested the Pakistan Electoral Commission to initiate the procedures for the disqualification of the five MNA by virtue of article 63a of the Constitution.

The five MNA had voted in favor of the 26th Constitutional Amendment bill, which allowed the Government to ensure 225 votes, one above the 224 required for approval.

The 26th amendment introduced significant changes in the judicial structure of Pakistan, including reviews of the judicial appointment process, the possession of the President of the Supreme Court and the composition of the Judicial Commission.
