Peshawar:
The Superior Court of Peshawar (PHC) has suspended the imposition and recovery of the recently introduced tax in all industries that generate electricity through gas -administered generators.
A division bank comprising Judge Syed Arshad Ali and Judge Qazi Jawad issued the restriction order on Wednesday.
The federal government had imposed the tax through a promulgated ordinance in January 2025, requiring that all captive energy producers pay a tax determined by the federal government.
However, the cement and textile industries, which are among the captive energy producers, challenged the ordinance in the PHC, asking the court to restrict the federal government to notify the collection rate.
The notification was subsequently issued on March 7, 2025, establishing the tax in RS791 by MMBTU. A formal request for the suspension of the notification was moved.
