The Pakistan Supreme Court restored on Wednesday the Law of the Army of Pakistan in its original form, annuling its decision of October 23, 2023 that had declared certain provisions of the unconstitutional law.
In a verdict of the majority 5-2, the Apex court confirmed the appeals presented by the Ministry of Defense and others, restoring the clauses attacked above, including sections 2 (1) (d) (i), 2 (1) (d) (ii) and 59 (4) of the Army Law.
Judges Aminuddin Khan, Muhammad Ali Mazhar, Musarrat Hilali, Hasan Azhar Rizvi and Shahid Waheed supported the verdict, while Judges Jamal Khan Commandkhail and Naeem Akhtar Afghan hidden from the trial.
The majority judgment has urged Parliament to make amendments necessary in the Law of the Army of Pakistan within 45 days to provide an independent right of appeal to the military courts convicted in the Superior Court.
