The Roman Storm defense team wants to know if the United States Department of Justice is retaining any information that can help the case of the cash tornado developer.
In a letter presented on Friday night, the defense lawyers said that recent revelations in another case, something similar, raised concerns that prosecutors deceived the judge who supervises the case or otherwise played “fast and loose.”
“The defense was recently learned that the Government has possessed exculpatory materials since August 2023 that go to the heart of a fundamental issue in this case: if a non -custodial cryptocurrency mixer is a ‘money transmission business’ by the end of 18 USC § 1960,” the presentation said. “The government’s failure to produce these materials in the fall of 2023, when the Roman storm was accused and appeared for the first time in the court, constitutes a rape of Brady that has materially harmed its defense”, even after the department of the department of the Cape Department would drop a part of its case against the storm.

The Storm team is referring to the case of the Department of Justice against two developers of Samourai Wallet, another cryptographic mixer. In that case, the defense lawyers said earlier this month that prosecutors delayed sharing that two officials of the Financial Crime Control Network (FINCEN) told the Department of Justice that the mixer did not seem like a transmitter of money.
The prosecutors denied the accusations in a judicial presentation, saying that their revelations were appropriate and that the opinions of Finnn officials were not a formal guide.
The Department of Justice said that the two cases are only “superficially similar,” said the presentation of the defense on Friday.
“But what the Government characterizes as a superficial similarity is, in fact, the central characteristic that is in the heart of the conflicting interpretations of the Finn Guide and the scope of section 1960:
