The jury also found him innocent for an additional position of sexual abuse in the second degree.

The incident occurred in Lake Oswego, Oregon, in October 2021, when McLore was identified as suspect by the authorities after the woman’s complaint.
In February 2024, a grand jury of clackamas county heard evidence in the case, which included the testimony of the woman saying that Mclemore assaulted her. Mclemore was arrested two months later by the American bailiffs.

During the trial, Scott Healy, a clackamas county prosecutor, told the jury that the woman passed out on a room sofa around 2 in the morning after drinking a lot. She regained partial consciousness the next morning, when Mclemore penetrated her sexually with her fingers and then proceeded to have sex with her.
The McLore team of lawyers played the claims, saying that he initiated sexual contact and consented to him. The lawyers also said that the woman was sober enough to consent to sexual contact.
McLore, a Kansas product, played nine seasons in the NBA, five with the Sacramento Kings, who took him seventh in general in the NBA Draft of 2013.
