The former volleyball coach of SJSU demands after a transgender athlete dispute

The former Women’s Volleyball Assistant Coach of the State University of San José, Melissa Batie-Smoose, has filed a lawsuit against the Board of Trustees of the State University of California (CSU). SJSU is one of the 23 California -based schools that are part of the CSU system.

The Batie-Smoose contract was not renewed when it expired in February, after being suspended from the team in the middle of the season for presenting a complaint of title IX about the management of a transgender athlete program on her team and a player who opposed the Trans athlete.

Now, Batie-Smoose alleges an unfair termination, claiming that “suffered and continues to suffer lost wages, loss of reputation and professional opportunity, emotional anguish and other damages.”

“The actions of the accused were intentional, intentional and/or taken with a reckless contempt for the rights protected by the federal federal,” says the lawsuit.

“Other coaches who did not oppose the inclusion of a biological man in the female volleyball team or who did not advocate for the rights of female athletes, were not subjected to suspension, termination or discriminatory actions such as demanding.”

A spokesman from the San José State University responded to the lawsuit.

“We are aware of the presentation and we have no more comments, due to a pending litigation,” spokesman told Pak Gazette Digital.

The complaint of the Batie-Smoose title IX against the school, which he presented at the end of last October, presented accusations that the transgender athlete, Blaire Fleming, conspired with an opposite player for his teammate Brooke Slusser to shoot in the face for a game.

Slusser previously joined a lawsuit against NCAA and presented another against the Mountain West conference, citing his experience of being made to share changing spaces and hotel rooms with Fleming without telling him the birth sex of Fleming.

Batie-Smoose was suspended in early November, while the accusations against Fleming caused an investigation by Mountain West in the situation.

Mountain West’s investigation determined that sufficient evidence could not be found, however, Pak Gazette Digital reported that the law firm hired to carry out the investigation, Willkie Farar and Gallagher (WFG), is the same company that represents the west mountain against the demand of Slusser, which also contains the accusations against Fleming of conspira of Slusser Darmed, as observed in the Public records obtained by Fox news.

Slusser also told Pak Gazette Digital who had a conversation with a teammate who was interviewed as part of WFG’s investigation.
