The Federal Government has decided to dispute the order of the Supreme Court with respect to the formation of a complete court in the case of contempt of the court that involves the additional registrar of Nazar Abbas.
Attorney General Mansoor Usman Awan reported the Constitutional Bank of the government’s position during a hearing on a regulatory duty of Customs.
The government plans to challenge the decision, describing it as unconstitutional, said Express News.
The ruling of the Supreme Court in the case of contempt declared that Nazar Abbas had not committed deliberately.
A bank of two members, comprised of the Mansoor Ali Shah Judge and Judge Aqeel Abbasi, withdrew the notice of the cause of the exhibition against Nazar Abbas, referring the matter to the President of the Supreme Court of Pakistan.
The Bank highlighted the procedural violations of the Committee on Practice and Procedure of the Supreme Court and the Constitutional Committee of the Judges, which had reassigned to administratively cases contrary to judicial orders.
The ruling declared that these committees lacked authority to cancel judicial decisions. The Bank recommended that the president of the Supreme Court form a complete court to address whether the actions of these committees constituted the court contempt.
The court also indicated that the problem is of such importance that guarantees the deliberation of all the judges of the Supreme Court collectively. This approach, the bank argued, would guarantee institutional integrity and the purpose in resolution of the matter.
The decision follows concerns about administrative interference in judicial processes, with the court pointing to similar precedents where larger banks were formed to address the problems of this magnitude.
