Islamabad:

Judge Jamal Khan Commandkhail has observed that the government should send all cases to the military courts for its award after declaring that the civil system has collapsed.

Judge Commandkhail is part of a constitutional bank of seven members of the Supreme Court, which on Monday resumed the hearing of the intra-cat appeal filed by the Government against an earlier order of the Apex Court, annulling the trial of the rufflers of May 9 in the military courts.

Pakistan Attorney General (AGP) Mansoor Awan began his arguments in support of Intra-Court appeals and pointed out that giving the right to appeal to persons convicted by military courts is a political issue, in which he would make presentations after receiving government instructions. Judge Commandkhail declared that Parliament should analyze the issues of politics and that the CB is supposed to be limited to the instantaneous case. “They must also make this political decision that the civil system has failed and that all cases should now be sent to the Military Court,” he said.

Agp Awan declared that he would present arguments about three points. “The lawyer of the Ministry of Defense, Khawaja Haris, has already given arguments about the events of May 9, 2023.

The Court postponed the hearing of the case until May 5.
