The lawyer hits Mountain West on the investigation of transgender volleyball players

EXCLUSIVE: The controversy of the transgender volleyball players of the State University of San José revived last week. Pak Gazette Digital reported that the Mountain West conference hired the same law firm to investigate the accusations of misconduct of the trans athlete that the conference was using to defend the eligibility of the athlete for the conference tournament in the Court.

“It is outrageous, inadequate and misleading that the MWC hired the same law firm to conduct a supposedly independent investigation of its SJSU member and defend the MWC in a federal lawsuit on Joint behaviors and actions of MWC with SJSU,” Bock said in a statement proportionate to Pak Gazette Digital.

Pak Gazette Digital reported on June 24 that Mountain West hired Willkie Far & Gallagher (WFG) to investigate the accusations against Blaire Fleming of conspiracy with an opponent to have teammate to have a teammate Brooke Slusser Darmed for a game of October 3.

Mountain West hired the firm to manage the investigation in the same month that the same company represented the conference to protect Fleming’s eligibility in a preliminary court request so that the transcalified athlete from the female competition and the conference tournament.

The investigation closed after only three days, and the documents obtained by Pak Gazette Digital showed that the researchers repeatedly incorrectly the game as played on October 2.

The WFG lawyer who directed the investigation into the accusations against Fleming, Tim Heaphy, then offered the legal advisor of the school to help him navigate a federal investigation of the title IX on the same situation, as seen in the public records obtained by Pak Gazette Digital. The offer was rejected.

Bock said the revelation “amazed him.”

“I was surprised to know that WFG was representing the MWC against the demand for Brooke Slusser at the same time that another lawyer of that company allegedly investigated the attempt to hurt Brooke and if SJSU and the MWC properly investigated those facts,” Bock’s statement continued.

“The hiring of WFG to play roles so conflicting and mutually exclusive suggests that Commissioner Nevarez and the MWC had no interest in discovering the truth. Instead, the MWC has long focused only on advancing on the interests of SJSU and promoting the narration that men should be allowed in the university costumes of women and exhibitions and compete against women in women University “.

Bock asked the United States Department of Education to investigate the situation.

“The Report from Pak Gazette Provides More Evidence of the MWC’s Scheme To Work Side-by-Me Law partners to continue milk the MWC for Legal Fees and The Positioned That Same Investigator to Later Seek to Monetize His Relationship With The MWC to defend SJSU in a federal investigation into the claims that he allegedly investigated “independently”, said Bock’s statement.

“BeSe Shocking Revelations of Conflicts of Interest Entirely Discredit The MWC and Will Hopefully Be Fully Investigated in the reported probe of sjsu’s conduct by the us department of education. Certainly, this investigator is Likely to Become a Key Witness in Brooke Slusser’s Federal Lawsuit Against The MWC and Sjsu, as His Hiring and Behavior is Additional Evidence that the MWC Worked Hand-In-Glove With Sjsu and was Far More Concerned with promoting a narrative that protect women. ”

Bock leads Sjsu’s demand against SJSU and Mountain West, and also leads a larger lawsuit against the NCAA directed by former university swimmer and current host of “outkick” Riley Gaines.

Bock previously called the conference on the accusations of Fleming “inappropriate and anything less thorough” in a statement on November 17 and asked that the evidence be revealed.

The conference did not reveal any evidence, since Fleming ended the season, won honors of all conferences and even took SJSU to the Mountain West championship game. The Trans athlete traveled and settled with the teammates to Las Vegas in the last week of November for the conference tournament.

After leading the investigation that eliminated Fleming positions in November, Heaphy contacted the university legal advisor of the State of San José, Dustin May on February 6, offering helping to navigate a federal investigation. President Donald Trump has just signed an executive order to try to enforce that mandate only weeks after his presidency on February 5. And only one day later, the Trump Department of Education launched a Research on SJSU About Fleming’s situation.

May rejected Heaphy’s offer on February 18, but Heaphy replied the next day, writing: “Let me know if we can help in some way about this or other problems.”

None of WFG lawyers have been accused of violating applicable rules of professional behavior.

Pak Gazette Digital has communicated with Mountain West, San Jose State and Willkie Farr & Gallagher for a response to Bock Declaration.

Doe’s research on SJSU’s management of the situation involving Fleming is in progress.

The White House provided a statement addressed to recent revelations to Pak Gazette Digital.

“President Trump undertakes to end the dangerous and unfair participation of men in women’s sport and restore common sense. President Trump will continue talking and taking immediate measures against schools that endanger the safety of female athletes,” said White House spokeswoman Liz Huston.

The Bock office presented an answer to the motions to dismiss the case on June 23. The answer mentioned the accusations against Fleming of misconduct.

The legal battle of WFG and Mountain West to keep the Trans athlete in the women’s tournament was successful, since the teams of federal judge Kato, appointed by President Joe Biden in January 2024, governed in favor of Fleming’s eligibility on November 25.

Two days later, after a failed appeal of the plaintiffs, the firm published an online press release that announced the legal victory to continue playing Fleming.

But that website has been eliminated since then. Pak Gazette Digital asked why the page no longer exists, but Willkie Farr and Gallagher did not respond to the investigation.

Archived data The original press release shows: “Willkie secured a high profile victory for the Collegiate Athletic Conference of the Mountain West Conference in a lawsuit filed by members of the Women’s Volleyball team of the State University of San José and other Mountain West teams that played against SJSU.”

Pak Gazette Digital previously communicated with Mountain West, Willkie Farr and Gallagher, the State University of San José and his chief volleyball coach Todd Kress with respect to the previous findings. Those parts have not provided any response.

May’s office initially responded to the request for comments from Pak Gazette Digital after providing public records, requesting a list of questions and background information before speaking. Pak Gazette Digital did not provide the information or the list of comments, and requested a virtual or telephone interview.

May’s office later responded with the statement: “Any speculation that the company or lawyer mentioned in its consultation represented SJSU or the CSU is unfounded.” Pak Gazette Digital had not raised that question or any other stipulation, just an interview application, at that time.

Pak Gazette Digital then continued with May’s office requesting an interview to address other questions and complied with his office request to provide information about what would be discussed.

May’s office responded by saying: “It will not be available” and has not responded to the request for more comments.
