Islamabad: The Ministry of Law and Justice has issued notifications for the permanent appointment of main judges to the four superior courts of the country, after the approval of President Asif Ali Zardari.
According to the notification, Judge Sarfraz Dogar has been appointed as the president of the Superior Court of Islamabad. Judge Junaid Ghafffar has been appointed president of the Superior Court of Sindh.
In Baluchistan, Judge Rozi Khan Bareech has been appointed president of the Superior Court of Baluchistan, while Judge Atiq Shah has been notified as the president of the Superior Court of Peshawar.
The development occurred a week after the Judicial Commission of Pakistan (JCP) nominated the main permanent judges for four higher courts.
In February, five IHC judges had transferred to the Apex court against the appointment of Justice to tell as the president of the Supreme Court of IHC, as well as the transfer of three judges of the Court superior to their court.
The plea was presented by Judge Mohsin Akhtar Kiyani, Judge Tariq Mehmood Jahangiri, Judge Babar Sattar, Judge Sardar Ejaz Ishaq Khan and Judge Saman Riffat Imtiaz.
However, the Top Court, on June 19, dismissed the supplications filed against the transfer of judges and ruled that Judge Dogar could continue working as the president of the IHC Supreme Court of IHC.
Later, President Asif Ali Zardari formally declared justice to give as the “most senior judge” of the IHC, after the issuance of an antiquity list reviewed by the Ministry of Law and Justice.
It is pertinent to know that the five IHC judges presented an Intra-Court (ICA) appeal against the verdict of June 19, SC.
In his plea, the judges urged the order of the Constitutional Bank to be “remembered and reserved […] in the interest of justice. “
“During the processing of instantaneous appeal, this honorable court can granting provisional relief as it was prayed in the application for provisional relief. Any other relief that this honorable court can be considered adequate and appropriate can also be granted,” said the petition.
