Islamabad:
A sister of Baloch’s rights activist, Dr. Mahrang Baloch, has approached the Supreme Court against an order of the Superior Court of Baluchistan (BHC) in the case of detention of her sister.
A BHC division bank on April 15 dismissed Dr. Mahrang’s request against his detention under the Public Order Maintenance Ordinance (MPO), 1960, stating that an alternative remedy was available for the activist in the form of representation.
The bank had also converted the petition into a representation and ordered its charge to present it to the competent authority constituted with the purpose of deciding the representations under the MPO.
The petitioner, Nadia Baloch, said that the BHC made an error in maintaining that a petition could appear before a court only after exhausting the option of presenting a representation.
The petition argued that the Superior Court in its written jurisdiction is competent to intervene and directly grant the relief to a petitioner by determining the legality of a MPO order without the need for the detained person to make a representation.
He said that the BHC did not consider Dr. Mahrang’s right to present Habeas Corpus’s request. “[This is her] High prerogative right and a constitutional remedy for all matters if illegal confinement, “said the petition.
