Maine officials filed a lawsuit against the United States Agriculture Department (USDA) on Monday after the agency’s decision to freeze funds to the State for their refusal to reverse their transgender athlete participation policy in schools.
The State accused USDA of “retaining the funds used to feed children in schools, child care centers and programming after school, as well as disabled adults in congregated environments.”

“Under the flag of keeping the children safe, the Trump administration is illegally retaining the subsidy funds that are destined to keep the children fed,” said Maine Attorney, Aaron Frey, in a press release. “This is just another example in which no law or consequence seems to restrict the administration, since it seeks capitulation for its illegality.
“The president and his cabinet secretaries do not make the law and are not above the law, and this action is necessary to remind the president that Maine will not be intimidated to violate the law.”
Frey added that the freezing of funds was “illegal” and requested a temporary restriction order against the department to retain the funds.

The USDA announced the freezing of funds and a review of federal funds to Maine after the State refused to provide equal opportunities to women and girls in educational programs.
The State has refused to comply with the executive order of President Donald Trump to ban trans athletes from girls and women, which caused immense federal pressure. Initially, Trump promised to reduce federal funds to the State if he refused to comply with the order during a speech on February 20.

The USDA secretary Brooke Rollins said the State must accept protecting female athletes from trans inclusion before financing is restored.
“To continue receiving dollars from USDA taxpayers, the state of Maine must demonstrate compliance with the title IX that protects student athletes from having to compete with or against or having to seem unleashed to men,” Rollins wrote in a letter to the State.
“In addition, the USDA has launched a complete review of the subsidies granted by the administration Biden to the Maine Department of Education. Many of these subsidies seem to be wasteful, redundant or otherwise against the priorities of the Trump administration. Frey claimed that the “Child Nutrition Program of the Department of Education of Maine could not access several federal financing sources, all of which are necessary to feed vulnerable children and adults” after Rollins has indicated that the freezing of financing would not affect the programs that keep the children fed.

The Department of Education also sent Maine’s “breach with Title IX” to the Department of Justice. The agency gave the state until April 11 to comply.
