The Constitutional Bank of the Superior Court of Sindh ordered the appointment of a lawyer with visual disabilities as a judicial magistrate under the rules of judicial services of Sindh.
A constitutional bank of SHC of two members, headed by Judge Kk Agha and also includes Judge Nisar, gave the orders by judging a petition presented by the lawyer, Sadiq Hussain, seeking a relaxation of the medical aptitude requirements for judicial appointments due to his visual disability.
The Bank ruled that Sadiq, a fiscal lawyer, is eligible for the position of judicial magistrate despite his visual disability. The decision requires the implementation of the appointment within four weeks, or in the next vacancy available.
In his written order, the bank ruled that Sadiq has been able to be maintained through its legal practice. The Bank also ordered that copies of its decision be sent to the Secretary of the Provincial Law and the SHC Registrar for its implementation. The legal advisor of SADIQ, the lawyer Haseb Jamali, had argued that his client underwent a medical examination on the recommendation of the Selection Committee, but his medical certificate was retained due to his visual disability. The selection committee had advised him to approach the SHC for the relaxation of the medical aptitude requirement.
The petitioner had submitted his application to the SHC registrar, but no measures were taken. The petitioner’s lawyer approached the Constitutional Bank requesting that the same benefits recommended by the Selection Committee be granted in 2015. The matter, waiting for 2016, was taken before the SHC again in 2024 by lawyer Jamali.
Sadiq, who had been fighting for nine years to achieve his goal, shared his gratitude. He revealed that his late father had always wanted him to become a judge and had supported him during his trip. Sadiq’s father died in 2018 before seeing the fruit of his son’s dreams.
