Islamabad:
The judge of the AThar Minallah Supreme Court has issued a dissenting note written by hand in a case related to the start of the contempt procedures against the SC Additional Registrar of Nazar Abbas.
The judge was part of the largest bank of six members who assumed the intra-court appeal of the additional registrar against a notice of show cause issued by a division bank.
Later, the petitioner had submitted an application requesting permission to withdraw the appeal submitted under section 19 of the Ordinance of the Unchanged Court, 2003.
On January 27, two members of the bank, Judge Shahid Waheed and Judge Minallah, dismissed the appeal for having been withdrawn. They had indicated that as the original bank had downloaded the contempt notice, the continuation of the appeal was no longer necessary or relevant.
In his note, Justice Minallah agreed with the opinion of Judge Shahid Waheed. He pointed out that the appeal appealed had become unsuccessful since the notice had been discharged.
“This bank was constituted under contempt of the Court’s Ordinance, 2003 read with article 204 of the Constitution of the Islamic Republic of Pakistan, 1973.
“There is no other pending work before this bank. With the discharge of the notification challenged now, no more, the appeal is dismissed, therefore, it is dismissed,” he added.
