The reserved judgments must be announced within 90 days, the JC panel proposes

The Subcommittee of the Judicial Commission has proposed that the reserved judgments must be announced within 90 days, as part of the new rules that are being discussed to evaluate the performance of the judges of the Superior Court.

The subcommittee meeting, chaired by Judge Jamal Khan Commandkhail, reviewed the procedures and rules aimed at evaluating the efficiency and conduct of the judges of the Superior Court, according to the sources.

One of the key proposals discussed was to link the performance of the judges with the timely elimination of cases, including the requirement of deciding issues in the list of causes daily. In addition, they declared that all subcommittee members were ordered to present their recommendations in writing for greater consideration.

The president of the Supreme Court of Pakistan, Yahya Afridi, had formed two committees, led by Judge Commandkhail, to prepare the draft rules for the annual judicial performance evaluation of the judges of the higher courts, as well as the criteria for the selection of judges for constitutional banks.

The 26th constitutional amendment ordered the judicial commission to carry out annual performance evaluations of judges of the Superior Court. If a judge is considered inefficient, the commission can grant an improvement period.

If the judge’s performance is still unsatisfactory after that period, the commission will send its report to the Supreme Judicial Council. Article 175a (20) also establishes that the commission can create separate rules to establish effective standards for the evaluation of the performance of the judges of the Superior Court.
