SC cancels the Order of IHC, except Judge Jahangiri of judicial work


The Supreme Court has annulled the provisional order that Judge Tariq Mehmood Jahangiri prohibited to carry out judicial duties. A Constitutional Bank of the Supreme Court accepted the appeal of Judge Jahangiri, ruling that “a judge cannot be restricted to perform tasks based on an interim order.”

A Constitutional Bank (CB) of the Supreme Court (SC) Directed by Judge Aminuddin Khan and comprising Judge Jamal Khan Commandkhail, Judge Muhammad Ali Mazhar, Judge Hassan Azhar Rizvi and Judge Shahid Bassan supervised the case.

Attorney General Usman Awan appeared before the Court, declaring: “A judge cannot be prohibited by judicial work through an interim order.”

The main lawyer Munir A. Malik questioned the order of the Superior Court of Islamabad (IHC) at today’s hearing, declaring: “In my opinion, the Supreme Judicial Council can only take measures against a judge.”

The written order of the SC pointed out that the request presented in the IHC entails certain objections, and the petitioner Mian Dawood said before the Supreme Court. The SC accepted the appeal of Judge Tariq Jahangiri against the IHC. The Superior Court must first decide on objections before continuing.

Judge Tariq Mehmood Jahangiri has resumed judicial duties and has reached his courtroom after being reinstated. He has begun to listen to cases again after the decision of the Supreme Court to restore him to his position.

Judge Jahangiri now presides over the cases in a single bank, and together with Judge Saman Rafat Imtiaz, his division bank is also available today for audiences.

The Supreme Court suspended on Monday the IHC order that had prohibited the judge of IHC Tariq Mehmood Jahangiri to carry out a judicial work. Subsequently, the IHC issued a new list of causes, restoring Jahangiri to single and division banks.

The case

On September 16, a division bank led by the president of the Supreme Court of IHC, Sardar Muhammad Sarfraz, had prevented Judge Jahangiri from performing his duties when he began the procedures in a request as quo order that he accused him of having a doubtful title of LLB.

This was the first time in the history of Pakistan that a superior court had prevented his own judge from listening to cases, an order of his lawyer called a blow to judicial independence.

On September 19, five IHC judges, including Judge Jhangiri, went to the Supreme Court in person to present separate constitutional requests, making eleven different sentences, including one that seeks the annulment of the IHC order that prohibits Jahangiri from judicial work.

And then, on September 25, the University of Karachi canceled the judge’s degree in the light of a previous decision of its union, which further complicated the situation.

Outside the court, a journalist asked Jahangiri about the decision of the University of Karachi to cancel his lawyer. “I have already presented a petition in the Superior Court of Sindh,” he replied. “It is surprising that they cancel a title after 34 years. This has never happened in world history.”
