White House press secretary Karoline Leavitt criticized Supreme Court justices for appearing to question biological differences between men and women during Tuesday’s hearing on how to save women’s sports.

The Supreme Court heard two cases involving transgender athletes in girls’ and women’s sports, with Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson putting pressure on state prosecutors seeking to keep women’s sports biologically female.

When asked by Riley Gaines at Thursday’s briefing if the administration is willing to take action against states that don’t comply with a potential Supreme Court ruling to save women’s sports, Leavitt responded: “Absolutely.”

“The administration… [has] We have taken action on several fronts against these states that do not respect the president’s executive orders and this administration’s policy of simply protecting women, women’s sports, and women’s private spaces. “We have also taken on the great universities in this country to try to fight for what is right and fair for women in this country.”

“I think the president speaks common sense on this issue, that sports and women’s private spaces should be protected, and that there are two genders, there are two sexes; that’s not something we should be afraid to say in this country.”

Leavitt then attacked the aforementioned judges for what appeared to be at least some devil’s advocate play during the hearings.

“And I think, frankly, it was quite alarming not only to hear a couple of justices debate that fundamental biological fact that men and women are different but inherently equal, but that we are certainly different and women deserve those rights,” Leavitt added. “We hope and expect that the Supreme Court will rule correctly on this matter.”

The consensus among experts is that Supreme Court justices and their conservative majority seem willing to let Idaho, West Virginia and other U.S. states uphold their laws to keep biological males out of girls’ and women’s sports.

President Donald Trump issued an executive order to save women’s sports in February. According to the Supreme Court, 30 states have restrictions on transgender athletes participating against girls and women.

A decision is expected this summer.
