Court orders arrest of former ISI chief Faiz Hameed’s brother after canceling bail


ISLAMABAD:

A special court on Wednesday issued a written order canceling the bail of Najaf Hameed, brother of former Director General of Inter-Services Intelligence Lt Gen (retd) Faiz Hameed, and ordered his arrest.

The written order was issued two days after the court announced its decision. FIA Central Special Judge Shah Rukh Arjumand issued a reserved verdict and recorded a slew of charges against the accused.

According to the order, Najaf Hameed is accused of preparing a false registration and fraudulently altering land records. The court said that instead of transferring a plot from a channel to the complainant, the accused allegedly transferred only 10 marlas through deception.

The order also records allegations that the defendant misused his official position for personal gain. He noted that an investigation is also underway under the Money Laundering Act.

The prosecution told the court that the arrest of the accused was necessary to ensure access to the material facts and complete the investigation. It held that an extraordinary measure such as bail could not be granted simply on the basis of the plaintiff’s statement or an alleged agreement.

Accepting the request of the Federal Investigation Agency, the court canceled the bail and ordered the arrest of the accused.

Several national media outlets reported that Najaf Hameed was not present in court when the order was announced and could not be immediately arrested.

The court noted that the accused had earlier been granted bail but held that the relief could not be sustained in view of the nature of the allegations and the needs of the investigation.

The prosecution maintained that relying on a complainant’s statement or an alleged agreement could not negate the need for custodial interrogation, particularly in cases involving abuse of official authority.
