The Islamabad High Court (IHC) has stayed the implementation of a decision ordering a private airline, Airblue, to pay around Rs 5.04 billion in compensation to the families of the victims of the 2010 private jet crash in the federal capital.
IHC judge Arbab Muhammad Tahir heard the appeal filed by the airline against the order of a district and sessions court in Islamabad.
The IHC judge, after hearing the preliminary arguments, issued a stay order on the request of the airline and notified the parties, directing them to file their responses by April 23.
Airblue lawyer Hasan Mandviwalla argued that lower courts had imposed liability beyond legal limits without finding any willful misconduct.
Mandviwalla further noted that the Air Transport Act 1934, which was applicable at the time of the accident, imposes an even lower threshold of liability.
