Although 12 names have been approved for their appointment as additional judges of the Superior Court of Sindh, the Judicial Commission of Pakistan (JCP) has lost the opportunity to appoint a first judge among the minorities of the Superior Judiciary.
Since the 18th constitutional amendment of 2010, there is no judge of any minority community in the Superior Judiciary that includes the Supreme Court or the five higher courts.
However, there was hope that the PCJ would approve at least a candidate of the minority community as an additional judge of the Sindh Superior Court during the meeting.
Previously, the president of the Superior Court of Sindh, Shafi Siddiqui, had recommended two names of the minority community.
However, they could not obtain the votes required at the meeting. One of them obtained eight votes at the JCP meeting, being short by a vote to become a SHC judge.
Regarding the approval of 12 nominations for additional judges of the Superior Court of Sindh, lawyer Salahuddin Ahmed has said that the PPP won the judges of the Superior Court of Sindh. “Future candidates for judicial positions must take note of this instead of worrying about irrelevant considerations such as polishing their professional credentials,” he added.
Regarding the rejection of two candidates for SHC, Salahuddin Ahmed has said that more delicate considerations, such as the promotion of diversity in the Judiciary, must often be sacrificed in such at odds electoral contests.
Moiz Mirza Baig Adv said that while the appointments approved by the PCJ include outstanding lawyers such as Osman Ali Hadi, Jaffer Raza and the general lawyer Hassan Akbar; The exclusion of the lawyers proposed by the president of the Superior Court of Sindh and Judge Mansoor Ali Shah renewed the concerns about the appointment process after the 26th amendment.
