Judge Shah “is not afraid of any reference”

The senior judge of Puisne of the Apex court, Syed Mansoor Ali Shah, said he is not afraid of rumoree to present any reference of misconduct against him in the Supreme Judicial Council (SJC).

“Why fear a reference when you haven’t done anything wrong?” The judge said, who was scheduled to become the president of the Supreme Court of Pakistan before the promulgation of the 26th constitutional amendment.

Judge Shah was having an informal interaction with journalists after the oath of seven new judges of the Supreme Court on Friday.

In response to a question, he said he would deal with the reference if he appeared and when he appeared. “I don’t have a personal enmity against anyone,” he added.

The Assistant of the Prime Minister on Political Affairs, Rana Sanaullah, declared earlier this week that two Senior SC judges were subject to the procedures of misconduct while writing letters on each issue that contained critical comments and leaked them to the media .

However, Sanoullah had issued a clarification later, stating that his statement on the presentation of a reference against the judges was not an ad or a threat.

Judge Shah and Judge Munib Akhtar were among the four judges who recently wrote a letter to the President of the Supreme Court of Pakistan, Yahya Afridi, about the issuance of a new list of seniority of the judges of the Superior Court of Islamabad (IHC) .

Previously, on December 7, Judge Shah wrote a letter to CJ Afridi, urging him to call a complete court to listen to the requests presented against the 26th constitutional amendment. Judge Shah had also written letters to the predecessor of Aphridi, Judge Qazi Faez Faez Isa on more than one occasion and severely criticized him for allegedly undermining the judicialcy on the day of his retirement.

In his recent interaction with the journalists, CJ Afridi had complained that the letters he received from some judges already leaked to the media before he could review them.

According to a report, the Federal Law Minister Azam Nazeer, Tarar, had declared that Rana Sanaullah never spoke about presenting a reference against the judges, except for presenting his point of view about the “misconduct” of some of the judges in the middle of the growing tensions about the nomination and transfer of major jurists.

Speaking to Express News’ Show Center Stage, the PML-N senator, Irfan Siddiqui, also clarified that the federal government had no plans to move a reference against any judge.

“If such an intention existed, the government would certainly have declared it. Such action is not carried out in secret; there is an adequate procedure for it. This action is not being considered, nor has it been discussed in the cabinet.”

He said Rana Sanaullah mentioned that the conduct of certain judges could fall into the category of a reference. “However, the Law Minister clarified that the Government is not presenting any reference.

“If such plan were in place, it would be made public,” he added.

Interaction with journalists

Responding to another comment from a journalist that the judges were not doing their job, Judge Shah declared that the performance of the judges could measure when they see their judgments and their final judgments.

“It is publicly available as to how many of someone’s decisions have been published in Law Books. All records are available on the Supreme Court website,” he added.

According to some reports, the president of the Supreme Court of Pakistan, Yahya Afridi, had allegedly said that the judges were not doing their duties.

The senior judge of Puisne said that he interacts with his brother judges and drinks tea with them. However, in a cryptic reference to their differences with other judges, he said: “What could he say if no one could see the elephant in the room?”
