The leader of Kashmir, Mishal Malik, wife of the imprisoned leader of Hurriyat, Yasin Malik, accused India of participating in terrorism and murders directed worldwide, stating that diplomatic efforts for themselves will not generate results for Kashmir.
She has urged Pakistan to take the case of Yasin Malik to the International Court of Justice (ICI), similar to the way India had presented the Kulbhushan Jadhav case.
Kulbhushan Jadhav, an officer of the Indian Navy, was arrested in March 2016 by the Pakistani authorities in Baluchistan for positions of espionage and terrorism. Pakistan then referred that the work for the Indian Intelligence Agency, RAW (research and analysis wing) and the realization of subversive activities to destabilize the country.
In April 2017, a Pakistani military court sentenced Jadhav to death, which caused a diplomatic confrontation between India and Pakistan. India denied the accusations of espionage and took the case to the International Court of Justice (ICI), arguing that Pakistan had violated Jadhav’s rights under the Vienna Convention by denying consular access.
In July 2019, the ICJ failed in favor of India, ordering Pakistan to grant Consulate Jadhav and review his death sentence. However, Jadhav remains in Pakistani custody, and diplomatic tensions about his case continue.
Mishal Malik has generated parallel between the movement of India to take the case of Jadhav to the inaction of ICJ and Pakistan with respect to Yasin Malik, urging that Pakistan must take similar legal measures to fight for the leaders of Kashmir .
Speaking at the Law Association of the Superior Court of Lahore, Mishal Malik claimed that his mother was recently poisoned and killed, highlighting what he called the undercover operations of India and cross -border terrorism.
‘Why can’t Pakistan take the case of Yasin Malik to ICJ?’
Mishal Malik questioned why Pakistan has not taken the case of Yasin Malik to CiJ, especially when India managed to present the case of the condemned spy Kulbhushan Jadhav before the International Court.
“If India can take the Kulbhushan Jadhav case to the ICJ, why can Pakistan not take the case of Yasin Malik there?” She asked.
She ruled out the idea of negotiations with India, stating that the dialogue has no value and will not lead to any resolution. “There is no benefit to extend an invitation for conversations with India,” he said, emphasizing that legal action in international courts is now necessary.
Ask for a stronger political action in Kashmir
However, Mishal Malik welcomed the statement of the Chief of the Pakistan army about the fight against ten wars for cashmere, qualifying it as a positive position. However, he emphasized that it is the responsibility of politicians to effectively present the issue of Kashmir before global leaders.
She urged political leaders to go beyond mere speeches and take concrete actions, which include:
- Follow diplomatic initiatives
- Organization of large -scale manifestations and protests
- Pressing for international legal interventions
“Kashmir leaders are being silenced”
Mishal Malik also criticized the Indian Judiciary, stating that the assholes have never received justice from the Indian courts. She claimed that India is involved in a systematic campaign to eliminate Kashmir leadership, imprisoning all key leaders to weaken the movement.
“All our movement is without leaders through a deliberate strategy. All our leaders have been thrown into prisons. The world saw how Syed Ali Geelani was martyred, and yet no one was responsible, ”he said.
He asked the legal and diplomatic communities of Pakistan to take decisive measures in international forums to challenge India’s actions in Jammu and Kashmir occupied by India-Eligal (Iiojk).
