Islamabad:
A new controversy on the reconstitution of Bank has appeared in the Superior Court of Islamabad (IHC), with Judge Mohsin Akhtar Kayani Bench Bench, previously listening to cases related to quotas, replaced by a new panel.
The former bank also included Judge Babar Sattar and Judge Sardar Ejaz Ishaq Khan and had held a hearing for the last time on March 6, established on April 10 as the next date.
According to the IHC website, the largest new bank has been constituted in the president of Justice Sarfraz Dogar Interim and includes Judge Khadim Hussain Soomro and Judge Inaam Amin Minhas.
The last Shuffle is part of a series of bank changes witnessed by the Court in recent months.
In particular, Judge Sardar Ejaz Ishaq Khan was also listening to a case of contempt of the court against the Superintendent of the Adiala prison for denying the meetings with the founding president of PTI Imran Khan.
During the hearing, Superintendent Ghafoor Anjum had requested that the cases related to Imran Khan meetings and contempt charges be together.
Subsequently, CJ Dogar Interim constituted a larger bank of three members and eliminated cases with instructions. However, Judge Ejaz Ishaq Khan initiated a separate proceeding of suo motu contempt that is still ongoing.
The Superior Court of Islamabad (IHC) suspended on Wednesday the elimination notices of the contempt court issued to the Director General (DG) of immigration and passports and a NAB director, while seeking the complete record of the request and contempt procedures of the Babar Sattar Court of Justice.
A bank of two members comprising the president of the interim justice Sarfraz Dogar and Judge Muhammad Asif issued the suspension order after hearing an appeal presented by immigration and DG passports.
The court indicated that the objection of the appeal had been eliminated and ordered that the matter be solved for the hearing the same day.
The contempt notice had been previously issued by a single bank in relation to a request that seeks the elimination of a name of the output control list (ECL).
According to the lawyer, the court had not only granted provisional reparation, but provided final relief when suspending the order to place the name of the petitioner on the air exclusion list.
The lawyer argued that the Immigration and Passport DG had acted at NAB’s request and did not arbitrarily include the name of the petitioner in the ECL. He argued that the exhibition cause notice issued to immigration and DG passports was, therefore, illegal.
The IHC Bank observed that the reasons raised in the appeal were worthy of consideration and issued notices to all parties, looking for their answers. He also ordered the court to attach the complete record of the writing request and the contempt procedures to the appeal file.
The original contempt notice had been issued by Judge Babar Sattar about the repeated breach of judicial orders regarding the elimination of the name of the petitioner from the air exclusion list, supposedly added by the NAB recommendation.
