Islamabad:
The judge of the Superior Court of Islamabad (IHC), Mohsin Akhtar Kayani, has observed that the president of the court, Sardar Muhammad Sarfraz Dogar, does not have the authority to withdraw a case of a bank through an administrative order.
“It is not possible to transfer a case of a single bank to a division bank. It is my position of principles that no case can be transferred in this way,” Judge Kayani said on Thursday when he heard a case.
A new controversy about the reconstitution of Bank arose at the IHC, with a larger bank led by Judge Kayani, who previously listened to cases related to the quotas, replaced by a new panel.
The former bank, which Judge Babar Sattar and Judge Sardar Ejaz Ishaq Khan also included, had made a hearing on the case on March 6 and had scheduled to resume the hearing on Thursday, April 10.
However, according to the IHC website, the case was included for the hearing before a three -member bank led by the President of the Justice Sarfraz Dogar and includes Judge Khadim Hussain Soomro and Judge Inaam Amin Minhas.
The New Bank was supposed to occupy the case on Thursday.
However, his hearing was canceled due to the lack of availability of judges.
During the hearing of another case, Judge Kayani expressed his reservation in motion. “Go and try to communicate this [to acting CJ]”The judge asked a lawyer, with a smile.
Previously, Judge Sardar Ejaz Ishaq Khan was also listening to a case of contempt to the court against the Superintendent of the Adiala prison for denying the meetings
with the founding president of PTI Imran Khan.
During the hearing, Superintendent Ghafoor Anjum had requested that the cases related to Imran Khan meetings and contempt charges be together.
Subsequently, CJ Dogar Interim constituted a larger bank of three members and eliminated cases with instructions.
However, Judge Ejaz Ishaq Khan initiated a separate proceeding of suo motu contempt that is still ongoing.
