In December 2023, the New York Times launched a lawsuit against Openai and Microsoft, claiming copyright violation. The New York Times alleges that Openai had trained his chatgpt model, which also promotes Microsoft’s co -pilot, by “copying and using millions” of his articles without permission.
The demand is still ongoing, and as part of it, the New York Times (and other plaintiffs involved in the case) have made the demand for Operai to be made to retain the Chatgpt of consumers and the data of the customers of the API indefinitely, for the anger of Sam Altman, CEO of OpenAi, which led to X.com Tweet, “we have been thinking recently about Privilege ‘;

Operai describes the demand of the New York Times as “without foundation”, and in a long publication on the Operai website, “how we are responding to the New York Times data demands to protect user privacy,” Operai presents his privacy approach.
Brad Lightcap, Coo, Openai, says that the demand of the NYT “fundamentally conflict with the privacy commitments we have made to our users. Abandon the privacy standards of long data and weakens privacy protections.”
Private investigations
As more and more people share intimate details of their lives with chatbots of AI, which often assume the role of a therapist, I can appreciate the need to be able to maintain private the conversations, however, I can also see the point of view of the NYT that if there is evidence that supports their claims against OpenAi, then you must have access to the fact that the data without open can not declare it too private to share.
At the moment, a chatgpt chat is eliminated from its account immediately when it eliminates the conversation and is programmed for the permanent elimination of the Operai systems within 30 days. The order would mean that even the deleted Chatgpt conversations would have to be retained by OpenAI.
As a chatgpt user, I have always appreciated the ability to eliminate conversations completely. If Operai is forced to comply with this application, then it will affect almost everyone who uses the service, in a free, plus, pro or equipment (but not the headline holders or EDU).
The order does not have an impact on API customers who use zero final data retention points under the openai ZDR amendment.
Operai has said that he has appealed the order to the judge of the District Court and will inform us when he knows more.
