The Supreme Court analyzes seniority under article 200


Islamabad:

The Supreme Court was postponed on Wednesday until Thursday (today) the hearing of the transfer case of the Judge of the Superior Court of Islamabad (IHC).

A constitutional bank of five members of the Apex court, headed by Judge Muhammad Ali Mazhar, presided over the hearing.

During the procedures, Punjab’s general lawyer advanced his arguments, stating that the West of Pakistan became a single unit in 1955 through the order of the Governor General of Pakistan.

As a result, all the court courts of the Superior Court consolidated in one, and a list of seniority was compiled based on the appointment dates of the judges.

However, Judge Naeem Akhtar Afghan commented that the situation in the present case was different, since no judicial training had taken place in relation to the transfer of judges to the IHC.

In response, the general lawyer clarified that his point was just to illustrate that the previous service and transfers of the judges had historically accepted.

Judge Afghan observed that the central question in the case is whether the transfer of the judge is considered permanent or temporary under article 200 of the Constitution.

In addition, he asked why a judge held the 15th position in the age of seniority, while 14 last -year judges were overlooked.
